THIS LIMITED WARRANTY CONSITUTES THE ONLY WARRANTY MADE BY ROCKY MOUNTAIN TANKS CONCERNING THE PRODUCT AND IT HEREBY EXCLUDES ANY AND ALL OTHER WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING ANY WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
UNDER NO CIRCUMSTANCES SHALL Rocky Mountain Tanks BE LIABLE TO YOU OR ANY USER FOR CONSEQUENTIAL, INDIRECT, SPECIAL, PUNITIVE, OR INCIDENTAL DAMAGES (INCLUDING, BUT NOT LIMITED TO, LABOR AND ANALYSIS FEES), WHETHER FORESEEABLE OR UNFORESEEABLE, BASED ON ANY CLAIM OF ANY OTHER PARTY ARISING OUT OF BREACH OR FAILURE OF EXPRESS OR IMPLIED WARRANTY, BREACH OF CONTRACT, MISREPRESENTATION, NEGLIGENCE, STRICT LIABILITY IN TORT, FAILURE OF ANY REMEDY TO ACHIEVE ITS ESSENTIAL PURPOSE, OR OTHERWISE. NOTWITHSTANDING THE FORM (E.G., CONTRACT, TORT OR OTHERWISE) IN WHICH ANY LEGAL OR EQUITABLE ACTION MAY BE BROUGHT, IN NO EVENT WILL ROCKY MOUNTAIN TANKS BE LIABLE FOR DAMAGES OR LOSSES THAT EXCEED, IN THE AGGREGATE, THE AMOUNT PAID BY BUYER FOR THE PRODUCT.
It is the customer’s responsibility to inspect all shipments before accepting and signing clear on Bill of Lading / Delivery Receipt. Customers are also responsible for unloading any shipment.
DAMAGES / CLAIMS
It is extremely important for the receiver of a shipment to inspect and note any damages of a delivery. All orders are inspected at the point of origin to make sure there is no damage when shipped. Once our tanks are turned over to the carriers, damage can occur. Once the receiver inspects the product and signs the Proof of Delivery / Bill of Lading that the tank or product is clear of damage, Rocky Mountain Tanks will not be responsible for damage done to the tank. At this point the customer/receiver will accept all responsibility for the tank/product and will be responsible for filing a claim directly with the carrier for the damage. If receiver does note damage of a shipment on the Bill of Lading, Rocky Mountain Tanks will gladly assist our customers.
Customers who choose to ship on their own freight accounts are responsible for filing claims with their freight carriers. Rocky Mountain Tanks cannot assist with claims or damages during transit in these cases.
Rocky Mountain Tanks works to provide the best possible lead times for our customers. There are some situations that Rocky Mountain Tanks cannot control, such as: fire, flood, strike, or other labor difficulty, acts of God, act of any governmental authority or of the purchaser, wrecks or delay in transportation, inability to obtain necessary labor, materials or manufacturing facilities from usual sources or due to any other cause beyond reasonable control. In the event of delay in performance due to any such cause, the date of delivery will be postponed by such length of time as may be reasonably necessary to compensate for the delay. Rocky Mountain Tanks cannot guarantee or ensure that any shipment can be made by any specific time or date. In any event, the company will not be liable for costs, including but not limited to any special, incidental, or consequential damages, including but not limited to loss of profits or income.
We do not keep credit card, debit, or bank account numbers on our server.
